My employer has asked me to work extra hours over the holidays. What exactly is the overtime law for nannies?
It’s good to be thinking about holiday schedules now, because as we all know, once they’re here it’s full speed ahead!
If you anticipate working additional hours over the next few weeks, it’s important to be familiar with the wage and hour laws that apply to household employees. For hours worked in excess of 40 in a 7-day period, you should be paid at an overtime rate of 1.5 times your regular hourly rate. Please note that unless otherwise stated in a contract or work agreement, there is no legal requirement for double-time pay on holidays.
With traveling, parties, and kids out of school, the holidays are hectic and it can be easy to lose track of hours worked. Before the holiday season completely sets in, we recommend sitting down with your employer to discuss their expectations for your work schedule, as well as any possible overtime hours.
